Warinussy: Poor Protection of Human Rights Defenders in Indonesia

The Government of Indonesia is lacking political commitment and has failed to take a clear stand in providing a safe, comfortable working environment for human rights defenders in Indonesia. They are not protected while carrying out their professional activities in various areas in Indonesia, particularly in conflict areas such as the Land of Papua (Papua and West Papua).

This has been proved by various types of physical intimidation towards human rights workers in the Land of Papua such as Theo Hesegem (an activist from the Papua Peace Network in Wamena), Peneas Lokbere (Coordinator of BUK in Jayapura), lawyer Olga Helen Hamadi (Coordinator of KontraS Papua in Jayapura), Fanny Kogoya (Coordinator of Walhi Papua in Jayapura) and most recently Octovianus Pogau (an online media journalist for Papuan Voice and contributor for an English language media outlet based in Jakarta), who was intimidated by members of the Manokwari police force last Tuesday (23/10).

Theo Hesegem received the same threats as those received by Peneas Lokbere and Olga Hamadi; they were visited and threatened with violence, as they undertook advocacy in relation to various cases where human rights violations have been indicated in Jayapura and Wamena. Fanny Kogoya has received some extremely brutal threats; her house has been ransacked, and it was suspected that this was carried out by police intelligence agents, in complete disregard of the law and human rights principles laid out in the Code of Criminal Procedure. Oktovianus Pogau in Manokwari was attacked by police forces from Manokwari Police District Command as he carried out his journalistic work following the KNPB demo on Tuesday (23/10) in front of the UNIPA campus in Amban, Manokwari.

As a Papuan human rights defender myself, I want to emphasise that the state is responsible for providing protection to all citizens of the country – in particular human rights defenders – from terror, threats and intimidation. The responsibility of the State is clearly laid out in article 28)4 of the 1945 Constitution which says “protection, promotion, enforcement and fulfilment of human rights is the responsibility of the state, primarily the Government.” The state is therefore responsible for fulfilling the right to freedom from fear, and this is not restricted for human rights defenders.

In connection with this, Papuan human rights defenders and all activists from non-governmental organisations who carry out humanitarian, human rights and justice work for civil society in Papua and West Papua will be undertaking consolidation work together. We will resist, legally, those actions of the state which are being used by unprofessional members of the security forces.

In particular, as regards the case of Octovianus Pogau in Manokwari, I urge the Head of Manokwari District Police force to receive the young Papuan journalist in question to file a police report, and carry out a prompt investigation in accordance with the mechanisms and legal procedure laid out in the Code of Criminal Procedure (Law 8, 1981), so that the perpetrator can be punished in accordance with his actions.

End the violence against Papuan journalists: Oktovianus Pogau

A statement issued by Pantau Foundation and Southeast Asian Press Alliance (SEAPA)

 

Jakarta (23 October 2012):- Police today attacked a journalist covering a rally organised by the West Papua National Committee (KNPB) in Manokwari in West Papua. Oktovianus Pogau, a reporter with Suara Papua and a contributor to the Yayasan Pantau, was beaten by five policemen while trying to take pictures of police use of excessive violence against the KNPB demonstrators in front of the State University of Papua, Manokwari. Pogau had displayed his press card, but some police did not stop the beating. He sustained injuries to his face.

 

The security forces had attempted to stop the rally but the KNPB activists went on with the demonstrations.

 

In Jayapura, police dispersed thousands of demonstrators using the water cannon and tear gas. In Manokwari, five people were reportedly shot but it is still not clear their conditions.

 

In 2011, two journalists were killed in Papua, eight were kidnapped and 18 attacked. Foreign journalists are required to apply for special permits to enter and cover stories in Papua since Indonesia took over the administration of West Papua in 1963. Only three news organizations, including BBC, obtained the permits last year.

 

Pantau Foundation and the Southeast Asian Press Alliance condemn the attacks against the media, especially in Papua where activists, human rights defenders and journalists are frequently targeted for their work. Since October, two veteran human rights defenders, respectively from Wamena and Jayapura, have moved out of Papua due to serious threats against them. 

 

We call on the police to:

 

1. Respect the rights of citizens to freedom of expression;

 

2. Ensure the safety of Oktovianus Pugao;

 

3. Stop all forms of violence against journalists;

 

4. Arrest and prosecute the perpetrators of violence.

 

 

 

We also call on the Indonesian government to:

 

1.    Open up Papua to international journalists and human rights monitors; and

2.    Guarantee the rights of all journalists working in West Papua  to ensure they can work free of violence, hindrance or intimidation from any members of the security forces

Two demonstrations held; 1 in Waena, one at Taman Imbi.  Jayapura is spread out across a wide area.

Taman Imbi event was banned by police, so majority of folks moved to Waena or went home after seeing police show of force.

Confirmed from Waena, Jayapura dispersal this morning: 5 arrests including Misael Maisini, Chairman of Front Pepera. Tear Gas and Water Cannon used, while KNPB were holding rally at the site of former KNPB leader Mako Tabuni’s assassination by Densus 88 troops in June. Outside the Perunas 3 Housing complex (Yakuhimo dormitory) that was raided last night by joint TNI/Police force hunting for KNPB activists. Rally due to end soon, please stay tuned.

MANOKWARI

Police arrest KNPB activists in front of Manokwari uni campus, beaten, & taken into police trucks, according field journo Oktovianus Pogau.

Oktovianus Pogau of SuaraPapua.com was badly beaten by five Indonesian police today while covering KNPB demo outside State University of Papua, Manokwari. Pogau showed press card but still beaten. His lips were bleeding. – via Andreas Harsono.

Independent sources confirm that KNPB peace demo forcibly broken up by hundreds of armed riot lice from Kapolres Manokwari, at 0930 West Papua Time.

Manokwari, latest unconfirmed reports: 3 Wamena men shot dead instantly, 2 critically wounded and in hospital, by massive TNI/Polri hunting party that has raided the Highland dormitories at the State University of Papua, searching for KNPB activists who have dispersed in terror, according to informants in Manokwari. Unconfirmed Reports that 2 Indonesian men on Motorbikes, believed to be undercover Special Forces or Intelligence officers, have been shot with bow and arrow allegedly from highlanders. Witnesses dispute if it was in retaliation for earlier shooting deaths, or was self-defence during raid – difference of less than a minute. Raids are currently ongoing, reports of hundreds of people being rounded up by Indonesian security forces shutting down KNPB demos. Developing story – please stay tuned.

Protestors to start at 10 am Papua time – likelihood of violent action by security forces – stand by
1. TNI have readied 5000 personnel, tanks (Panzer APC/ASLAVS) and helicopters in Jayapura. All are on a state of alert.

2. Just heard from one of the protestors on site that said police are gathered in large numbers in Jayapura

“Apparently a lot of people ), have flown down to Jayapura from Wamena these last days to join there as too unpredictable how Indonesian security forces may retaliate in Wamena.”

Last night, major sweeps occurred in Waena to arrest any higlander potentially involved in KNPB demos today. At 10:43pm, hundreds of fully armed police complete with equipment and Panzer armoured personnel carriers, scores of Avanza cars, overran National Housing Authority dormitory complex III (Yakuhimo regency student accommodation). Massive sweeping, many arrests, beatings, unconfirmed numbers.

KNPB members rallying across Papua today held prayers last night, telling WPM “we are ready to be killed today”. 10am Papua time rally start, massive violence expected from security forces. “It felt like the night before battle where only one side has guns, said WPM’s stringer. Please monitor.

Indonesia cannot kill our spirit for freedom: West Papuan leader

West Papuan independence organisation, the West Papua National Committee (known by its Indonesian acronym KNPB) continues to defy the Indonesian security after a series of arrests and attacks on the group in Wamena, Timika and Jayapura.

Speaking from a safe house KNPB Chairman, Viktor Yeimo told West Papua Media that the police were vigorously repressing the group’s right to freedom to organise and right to nonviolently express their political opinion.

“I am in hiding but I have to try and keep organizing. KNPB have plans for peaceful demonstrations in Sorong, Manokwari and Jayapura. The police won’t allow us to make a peaceful action but we will still have a peaceful action.”

Early on Friday morning officers from the Indonesian police and Australian and U.S aided counter-terrorist group Detachment 88 raided KNPB’s Timika headquarters. Four Papuans, Steven Itlay, Chairman of the Timika region, Romario Yatipai, vice-president of KNPB’s parallel parliamentary structure the West Papua National Parliament, Marten Kalolik, and Denias Tekege were arrested. Laptops and cameras were also seized. The arrests in Timika follow raids and arrests of ten activists in Wamena, raids on villages and an attack on a student dormitory in Jayapura last Tuesday. Some of those arrested are teenagers. Others like Simson, a student activist from Jayapura were beaten by the police to extract information.

Virtually the entire KNPB leadership has now gone underground. In addition to Viktor Yeimo, Fanny Kogoya, ex-member of the KNPB central committee who resigned from KNPB after being elected Director of the Papua Desk of Friends of the Earth Indonesia, and Simeon Dabi chairman of the Wamena branch of KNPB are all on the run. Their faces are pasted in the streets of Wamena and Jayapura under the ominous heading, “Daftar Pencarian Orang”, the list of wanted persons. In Fanny Kogoya’s case her only ‘crime’ is that she was a close friend of Mako Tabuni, the KNPB activist killed by Detachment 88 in June.

Indonesian police accuse KNPB of being behind a series of shootings and bombings in West Papua that have rocked the country in recent months. It is an allegation that Yeimo vigorously denies.

“All this evidence is planted so they can justify their attacks. We never had any plan or any program to make acts of terror. We are not a military movement. If we were a military movement we would be the TPN (West Papua National Army) but we are a civilian movement. The Indonesians fear our movement, they want to make a public opinion that we are terrorists so they can kill us.”

Yeimo pauses.

“But they won’t succeed” he tells me quietly. “Indonesia won’t success to stop our movements for the right. Indonesia cannot kill our spirit for freedom.”
