Manipulation: Komnas HAM report on 2003 arms dump assault

Assault on arms dump in Wamena was a manipulation, says Komnas HAM member

The deputy chairman of the National Human Rights Commission, Papua branch  Matius Murib, has told the press that the solution to the assault on the arms dump of the Wamena district military command on 4 April 2003 now depends on the state and the attorney-general’s office.

‘The Komnas HAM, as a state institution, has completed its task of conducting a pro justicia investigation and has delivered its evidence and associated data to the attorney-general. But the attorney-general has responded, saying that the evidence is not strong enough,’ he said. ‘Our job is finished and we cant do anything more on the matter,’ he told JUBI.

The pro justicia report recorded that nine people were murdered, 38 people from 25 kampungs were forcibly evicted, 42 people died from starvation and fifteen others were treated unjustly.

With the Konmas HAM having done its work, it now depends on the goodwill of the state and the attorney-general’s office  to solve the case. In his opinion, this would mean bringing the case before the judiciary, and in this case, this would mean submitting it to the human rights court because, he said, ‘ this was a case of gross violation of human rights which must be heard before the human rights court.’

He went on to explain that this was not a case involving any bloodshed. It should be regarded as something that was deliberately manipulated. ‘I was at the location at the time,’ he said. ‘Just imagine, the arms dump is in the centre of town, yet even so an assault took place. This can only have been a deliberate manipulation,’ he said.

He also referred to the Wamena Tragedy of 6 October 2000 which resulted in many casualties and much spilling of blood. ‘Many ordinary (people) were tortured. This was also a case of serious human rights violations,’ he said.

Students want firmer action by Komnas HAM in Papua

The Student Executive Board of the Cenderawasih University Law Faculty has called on the Papuan branch of Komnas HAM, the National Human Rights Commission, to take firmer action regarding a number of human rights violations in Papua.

Chairman of the Board, Thomas CH Syufi, said that they felt that the
Commission had not done enough to handle the cases and hoped that Komnas HAM would investigate a number of cases of violation. He mentioned in particular the murder of Theys Hiyo Eluay, chairman of the PDP, who was murdered in November, 2001. The case is still unsolved to this day.

Komnas HAM was also urged to collect more accurate data about a number of human rights violations in Papua because in many of these cases, the data is far from accurate.

He said that collecting data and documentation was very important
because of the need to anticipate the failure of the State to handle the cases, in order to prepare for the possibility of submitting the cases to the International Court or the UN Security Council.

He stressed the need for Komnas HAM to take firm action to investigate every human rights violation that occurs in Papua.

JUBI on deplorable human rights situation in West Papua

The National Human Rights Commission [Komnas HAM] in Papua has called on the Indonesian government to take responsibility for a number of human
rights violations that have occurred in West Papua.

‘It is for the government to resolve these problems,’ said Matius Murib,’ who insisted that the government must take responsibility for this situation. He said that if the government fails to do anything, the number of violations will continue to increase. ‘There is no other way out of the problem,’ he said. It was, he said a matter for the central and also the provincial governments.

He said he has the impression that the state has simply washed its hands of the issue. Nothing is being done about it. The evidence is, he said, that the provincial government has issued no special regulation to strengthen the hands of the local Komnas HAM. There was a need for a regulation that would strengthen the legal position of Komnas HAM.

KontraS, the Commission for the Disappeared and the Victims of Violence,
has raised the issue of the formation of a Commission on Truth and Reconciliation and a Human Rights Court in Papua.

Speaking on behalf of the Commission, Harry Maturbongs said that these two bodies should be set up in accordance with the Special Autonomy Law for Papua, 21/2001.

He also said that people were still waiting for the solution to a number of past serious human rights violations, such as the Wasior case and the case of the assault on an ammunition dump several years ago.

KomnasHAM holds dialogue about cases of violence in Papua

KomnasHAM is trying hard to discuss the continuing violations of human
rights and the use of violence still occurring in Papua, Ridha Saleh
told journalists in Jayapura on Wednesday. He said that after reporting
the videos of torture and the burning of prisoners’ vital organs to the
military commander of Cenderawasih Military Command, they were keen to have a dialogue and seek opinions about these violations that are still occurring in Papua.

He said too that prior to reporting the case of the videos, they had
undertaken investigations and collected data about these cases which
occurred recently in Puncak Jaya. They were told that according to the army and the local people, there are three elements who have been causing chaos in Puncak Jaya, the TPN/OPM, the Indonesian army and o-called unknown elements.

A dialogue had taken place with all these people and also involved some other people, including some academics, the department of law and human rights, the army and members of the community.. The dialogue took place at Swissbel Hotel in Jayapura.

IHRC: Freeport must show respect for Komnas HAM

Press Release by the Indonesian Human Rights Committee for Social Justice (IHRC)

A forum which was to be mediated by the National Human Rights Commission 
- Komnas HAM - involving four customary clans which form part of the 
Amungme people, along with the copper-and-gold company Freeport, which 
should have taken place on 18-19 October 2010 could not take place as 
planned because Freeport showed ill-will towards the event and said that 
it would not attend. The company simply sent the convenors a letter on 
18 October suggesting that the event should be postponed till 15 
November 2010.

At a meeting which took place on 19 October, Freeport only sent members 
of their staff, so Komnas HAM  decided to re-schedule  the mediation 
forum till 27 October at 9am, at its office.

In view of these developments, the IHRC wishes to state the following:

Freeport has shown disrespect and ill-will towards an institution of the 
Indonesian Republic, namely Komnas HAM, as well as disrespect for the 
legal system of this country.

Freeport has shown ill-will and disrespect for the dignity of the elders 
of the Amungme and Kamoro people and towards the directors of Lemasa and 
Lemasko, the bodies that represent those who hold customary rights over 
the land that is being used by Freeport.

Komnas HAM should act seriously and speedily in its efforts to resolve 
the dispute between Freeport and the Amungme and Kamoro people by 
convening a Mediation Forum on 26 October to be attended by the 
leadership of Freeport and the leadership of Komnas HAM, in order to be 
able to reach a peaceful, democratic and dignified resolution that 
ensures justice for the victims. If the mediation forum on 26 October is 
a failure, the Amungme people who live in mountains and the Kamoro 
people who live along the coast will organise a peaceful mass action 
which will take the form of a boycott of all the products of Freeport.
