Indonesia’s police are brutal and corrupt – and apparently untouchable

TEN years ago, as Indonesia emerged from economic chaos and the military-backed Suharto regime, the government was everywhere planting seeds of democratic reform. Among them was to split the national police from the armed forces in 2000. Ever since Indonesia declared independence in 1945, the police had been the neglected, ill-equipped little brother of the army. The idea of detaching them was to make them solely responsible for law enforcement across the vast Indonesian archipelago, while the armed forces retreated to their barracks.

A decade on, this reform effort has worked—but not necessarily in the ways that its drafters envisioned. The army is relatively quiet these days, having been forced to begin selling its business interests and attempt, somehow, to modernise despite tiny budgets and antiquated equipment. What is more, it has not intervened in the democratic process.

The national police, meanwhile, have indeed managed to assert themselves as the country’s enforcers of law, including taking the initiative against Indonesia’s home-grown Islamist extremists. Unfortunately, capturing or killing terrorist suspects is just about the only thing they are applauded for these days. Most people see the police as a liability: deeply corrupt and untrustworthy.

The past several months have been particularly troubling, even by the force’s low standards. In late June Tempo, a prominent Indonesian news magazine, ran a cover story revealing that more than a dozen senior police officials had suspicious bank accounts, some of which held millions of dollars. A week later an anti-corruption activist who helped expose those bank accounts was brutally beaten by unknown men, apparently in retaliation.

In mid-August the police’s top brass were forced to admit that they had no evidence implicating two senior anti-corruption officials caught up in a sensational graft investigation in 2009. This gave credence to allegations that the police had conspired to frame the pair because of a personal grudge. Separately, on August 31st police officers in Central Sulawesi province fired into a crowd of people protesting the death of a local man in police custody. Five people were killed and 34 injured. In mid-September in West Papua province police killed two men and injured a woman after a traffic dispute boiled over.

Two days before the West Papua incident, the police’s counter-terrorism unit, Densus 88, was accused of torturing independence activists in Maluku province. The unit, funded by the United States and Australia, was alleged to have tortured the activists during a visit by President Susilo Bambang Yudhoyono in early August.

The allegations came just as another Maluku separatist, Yusuf Sipakoly, died in custody of injuries his family claims were caused by torture at the hands of the police. The allegations fit a familiar pattern. Last year Amnesty International released a report detailing a pattern of widespread torture, sexual abuse and exploitation by police, and ill treatment of suspects during arrests, interrogation and detention in Indonesia. And the police have been accused of standing by as minority Christian groups in towns outside Jakarta have been repeatedly harassed in recent weeks by hardline Islamist groups. Police have even been accused of colluding with radicals in local extortion and thuggery rackets.

So far, aside from appointing an “anti-mafia” committee to help clean up the police as well as a corrupt judiciary, the president has shown little interest in reining in the force. Mr Yudhoyono, a retired army general, has refrained from punishing senior police officials for their long list of alleged transgressions. Sometimes he gives the impression of defending them. In early October the president nominated Timur Pradopo, the Jakarta police chief, to run the national force, despite allegations of his involvement in the killings of student demonstrators in the build-up to Suharto’s ejection from power back in May 1998, and again on a university campus later that year.

During his final press conference in late October the outgoing national police chief, Bambang Hendarso Danuri, attempted a mea culpa, apologising, profusely and repeatedly, for the excesses committed on his watch. The public, however, are unlikely to be forgiving. The force has had successes in its counter-terrorism operations, which have seen hundreds of terrorist suspects killed or put behind bars, including some of South-East Asia’s most wanted fugitives. But even that has come at a price. In September armed men attacked a police station in Medan, North Sumatra province, killing three officers, in an apparent retaliation for the capture or killing of terrorist suspects. The public was shocked by the ambush, but there was a notable absence of outward sympathy for the three slain officers. Given the force’s recent conduct, that kind of reaction could become depressingly familiar.

Flash Flood in the Land of Papua: President Must Declare As a National Disaster

The Flash flood that swept Wasior City, Teluk Wondama, West Papua, on Monday (4 / 10) has killed more than 90 people. Meanwhile, according to a report from the Metro TV (7 / 9), there were 837 injured and 66 people remain missing. We believe that the number of victims will certainly continue to grow.

Observing the scale of the disaster and the number of victims, this disaster is not a normal disaster. Flooding in Wasior is not just a local disaster, but a national disaster. Anyone who feels a part of the Indonesian nation must be concerned with the suffering that is suffered by our sisters and brothers in Papua.  “Much less us as the Indonesian nation, the American people  located far away also expressed their concern through their Foreign Ministry (sic) statement by Hillary Clinton,” said General Chairman of PB HMI, M Chozin Amir.

“Unfortunately, the government now seems less serious and less responsive to respond to the disaster.” The government is too busy with its elite politics as well as for projects from the foreign debt fund, so that when their people affected far-away there, they were just ignored . Moreover, President SBY is too preoccupied with his image, so he forget the things that are substantial, such as helping allay the disaster that befell his people, “said Chozin further.

Even so well with the media, while they so aggressively report politics of the situation in the capital, they forget (or purposely forget) to report the disaster that occurred in the eastern tip of Indonesia. Yet when these disasters strike outside Papua, the media usually also heavily preach.

Because of the lack of response and weakness from government, especially the (national) news media, the Executive Board of the Association of Islamic Students (HMI PB) hereby declare:

1. Request for the President on behalf of the government to announce that Wasior flooding disaster as a national disaster, so that all elements of this nation is concerned specifically and able to give a helping hand.
2. Asking the media to proclaim extensively the scope of the disaster crisis, so that people will open their conscience to help our brothers and sisters at there place.
3. Call on all elements of society to set aside part of condolences to give sustenance to help the flood victims. Papuan Society is part of the Indonesian nation, then it becomes our collective responsibility to help alleviate their burden.

Herewith we submit that the PB and also officially HMI will send aid to flood victims.
Distribution of aid will be delivered by representatives of HMI in Papua, namely HMI Cenderawasi Coordinating Board in collaboration with HMI Branch of Jayapura, Manokwari, and  Sorong.

Papua floods may fuel tensions

Disaster in West Papua could add to local grievances as aid workers struggle to reach the affected areas.

Relief workers say they are struggling to reach West Papuans hit by heavy flooding in the Indonesian province.

Criticisms over tardy relief effort are already beginning to emerge from the region, where relations between the indigenous Papuans and the Indonesian state have long been difficult.

There are fears that a failure to address the humanitarian crisis could add to tensions over the recent killings of indigenous Papuan protesters by the Indonesian security forces in the towns of Wamena and Manokwari.

Denny Yomaki, a humanitarian NGO worker, told Radio New Zealand International on Thursday that some of the flood’s victims felt the state was not doing enough to assist them.

Aid workers told Al Jazeera the damage from the landslides has made it hard to reach the worst hit areas.

Hundreds have fled or been evacuated from the devastated seaside town of Wasior to seek shelter in Manokwari, the province’s capital. Most are staying with extended family or in makeshift shelters on a military base, Ridwan, a member of the disaster management team for the PMI (Indonesian Red Cross), told Al Jazeera.

“The current situation is very difficult, it’s very difficult to reach Waisor,” Ridwan said.

Red Cross barred

Ridwan said that the conflict was not affecting his organisation’s relief efforts in West Papua, but the International Committee of the Red Cross (ICRC) is restricted from working in the province, even in the aftermath of the recent disaster.

It was forced to close its West Papua branch in April 2009, but is providing funding to the PMI’s response to the flooding.

“We are not actively present in the area for the present,” Patrick Megevand, the spokesperson for the ICRC’s Indonesia delegation, told Al Jazeera.

The government told A Jazeera it had dedicated 200 million rupiah ($22,000) to the relief efforts following the flooding, which left at least 91 people dead and and more than 800 others injured, many of them suffering broken bones.

Maman, an officer at the National Agency for Disaster Management (BNPB), said the government had sent tents, food and medical supplies to Wondama Bay, along with army, police, technicians and medical workers. A navy boat and three cargo ships have already set off for the area.

The flooding comes at a time when calls for independence for West Papua and Papua are growing, especially in the wake of heightened US interest in the provinces. Indigenous Papuan leaders say that the “special autonomy” status granted by Indonesia in 2001 has been a farce.

Nick Chesterfield of West Papua Media told Al Jazeera that if the aid were felt to be insufficeint by those living in the stricken villages there is a risk it would enflame the tensions between the indigenous Melanesian populations and Indonesian security forces.

West Papua has already been hit by two major earthquakes this year and the government-led relief efforts were “very slow,” Chesterfield said.

He also warned that the aid effort could be compromised by anger over two separate incidents in which the police have killed local residents in recent weeks.

Police killings

The latest alleged killing was in Wamena, a town in West Papua’s highlands, just days ago.

Local authorities there have established the unarmed peacekeeping force, known as Balim Petapa, “to keep away the Indonesian police, their proxies and militias,” Chesterfield explained.

Violence broke out after a group of people from the force confronted police at the Wamena North airport to demand an explanation for the seizure of a box of berets – their uniforms – along with 40 million Rupiah ($4,468) in cash.

In the other incident, a priest, his wife and son were shot by Indonesian police in the city of Manokwari, which is close to the flooded areas.

Reverend Naftali Kuan, his wife Antomina Kuan and their 23-year-old son Setinus were shot by police on September 15 as locals protested a hit-and-run road accident by a member of the security forces, who fled to police headquarters after accidently running down an elderly Papuan woman on his motorbike.

In the days after the shootings, thousands of protestors took to the streets. Indonesian soldiers were sent in to quell the demonstrations.

“Manokawri has been one of the hotbeds for independence for years,” Chesterfield said. “If the Indonesian army doesn’t put down its guns and pick up its shovels, there’s going to be a lot of tensions there.”

According to the military commander of the Cenderawasih Command, there
are no separatist groups functioning in Papua any more, Security can
therefore be left to the police, with the army providing back-up when
called upon to do so, said Major-General Hotma Marbun. 'If there were
any separatists, we would crush them,' he said.

He was speaking on the occasion of the 65th anniversary of the
Cenderawasih military command, he said. Asked about the 'Papua Peace
Force' which has been announced by Forkorus Yoboisembut, chairman of
DAP, the Papuan Traditional Council, Hotma said: 'There is no such
thing. I dont know anything about it. If it did exist, it wouldn't mean
anything. They are using the word peace, aren't they?'

A message was read out on behalf of the commander of the Indonesian
armed forces Admiral Agus Suhartono. He said that reflecting the
emerging global framework strategy and Indonesia's national interests,
the country is facing a number of threats to its national security
including security in South Maluku, terrorism, separatism, violations of
its borders, natural disasters, illegal activities (no mention about
what these are), horizontal conflicts and a lack of energy resources.

In the context of the strategic environment, he said that Indonesia
faces the threat of global warming and  continual endeavours together
with all components to safeguard the integrity of NKRI, the Unitary
State of the Republic of Indonesia. He then said that the armed forces
would continue to pursue the process of reformasi.

‘SAFEGUARDING THE HISTORY OF THE MORNING STAR’

STATEMENT

The mega project, the Merauke Integrated Food and Energy Estate – MIFEE – was announced on 18 February 2010 by the former Bupati of Merauke, J.G
Gebze and officially launched on 11 August 2010 by the Minister of Agriculture, Siswono Yodohusodo on behalf of the President. The project
will involve 36 investors, 13 of whom are already operating in the area. The project will cover an area of 2.5 million hectares and bring into
the area a work force of four million people.

MIFEE will have an impact on every aspect of the lives of all indigenous Papuan people, particularly the Anim Ha customary people in South Papua.
The project which has been declared a National Food Granary is unacceptable to the local communities. On 8 August 2010, the customary
Ha Anim people sent a letter to President Yudhoyono but the Indonesian State has ignored the Ha Anim people’s rejection of this project.

The attitude of the government is in contravention of the principles of democracy that have been adopted by the Indonesian state. Any legal
instrument or policy that the government intends to adopt must conform with genuine democratic mechanisms. We herewith make seven points that
would comply with these democratic mechanisms, which the government should take account of in the implementation of this project:

One, in recognition of the aspirations of the people, any government policy should be acceptable to the people after having been made public.
In the case of MIFEE, this has not happened. The MIFEE project was on the working agenda of the SBY-Budiono regime for a hundred days and it
was never made public. The decision to launch the MIFEE project did not involve the people who have customary rights over the land; there were
no meaningful negotiations in compliance with rights and responsibilities taking into account the needs of the people. In other
words, the government and the investors regard this region of Papua as being land that doesn’t belong to anyone. The government and the
investors are not interested in the people but only in the land and its natural resources.

Two, the aspirations of the people as well as the policy of the government should be drawn up within a legal framework. In the case of
MIFEE, the interests of the Indonesian state are involved and therefore during the one hundred day period, the SBY-Budiono government entered
into a Memorandum of Understanding – MoU – with the foreign investors, after which the MoU was adopted as a draft regional regulation – RAPERDA
– of the district of Merauke.

Three, the results of these decisions should have been discussed with the people. In the case of MIFEE, neither the MoU nor the RAPERDA were
discussed with the people. Nor did the plans that were drawn up involve the customary people, the owners of the land. Neither the Indonesian
government nor the local government did anything to publicise the MoU or the RAPERDA.

Four, adoption of the legal documents. The MoU entered into by the SBY-Budiono government during the one hundred day preparatory period was
adopted as Regional Regulation (Perda) No 23 by the Bupati of Merauke, John Gluba Gebze.

Five, there was no announcement of the decision that had been taken regarding the MIFEE project. As is always the case in Papua, the
decisions were not made known to the people: neither the MoU nor the Perda were made known to the customary owners of the land.

Six, adoption of a legal decision. The announcement of the MIFEE project by John Gluba Getze on 12 February, 2010, the 108^th anniversary of the
town of Merauke, was officially announced on 11 August 2010 by the minister of agriculture, Siswono on behalf of the President of Indonesia.

Seven, should the decision fail to comply with the interests of the people, it should be revoked, either because (a) it is ineffective or
(b) the decision in question should be amended if it is lacking in any material way. In the case of MIFEE, the Indonesian state closed its ears
to the many protests made by the indigenous people, by observers and by NGO activists. This is obvious from the fact that thirteen companies are
already operating in Merauke.

As regards the social implications, the number of inhabitants in each kampong could decline sharply and they will become a minority as
compared to ethnic groups brought in from outside Papua, a situation that will become even worse with the arrival of four million low-paid
workers, some of whom have already arrived and who will continue to arrive to work on the MIFEE project. The companies and the government
have never involved the local communities in any decision-making or other mechanisms in compliance with the basic daily needs and customs of
the local communities. The local inhabitants have become mere spectators. These violations have become part of the ‘culture’ of the
companies and the government with MIFEE serving the interests of the Indonesian state and the foreign investors. As a result, social problems
are emerging, such as ethnic cleansing or genocide which infringe the ethical and moral principles of the local tribes and the indigenous
Papuan people in general.

In view of all the above and in order to safeguard the people and land of Papua from the threat posed by the mega MIFEE project, a meeting was
held on 4 June at the OFS Convent, attended by young Papuans and students, primarily from South Papua . It was decided to set up the
Papuan People’s Solidarity to Reject MIFEE or SORPATOM.

One of its activities was the public discussion held on 11 August in Jayapura the theme of which was: ‘Investments in Papua, especially
MIFEE: A catastrophe or a blessing for the Indigenous Papuan people?’

In view of the threats posed by investments, in particular the MIFEE Mega Project, we hereby declare:

1. We support the position adopted by the Ha Nim indigenous people and their sympathisers who reject the MIFEE project on their land
because it poses a threat to the right to life of the local communities.
2. We urge the Indonesian state – SBY – to repeal the MoU about MIFEE.
3. We urge the local government to immediately revoke PERDA No 23 about MIFEE.
4. We call on the provincial assembly, the DPRP, to hold a hearing attended by all those affected, to discuss the MIFEE project.
5. We call on all those who are concerned with safeguarding the people and the land to close ranks and reject every form of
investment which poses a threat to the right to life of the local communities, especially the MIFEE project.
